Terms and Conditions

In short, before the detail: our jewellery is made to order and, where applicable, personalised to your specification. For this reason no right of return or withdrawal applies. The statutory warranty for defects, by contrast, remains fully valid. Please measure your size carefully before ordering: we do not resize finished jewellery.

1. Scope

These terms and conditions govern all contracts concluded through areposwiss.com between AREPO, sole proprietorship of Davide Aliano, Via Arbostora 15, 6913 Carabbia, Switzerland ("AREPO", "we") and the customer ("customer", "you"). By placing an order, the customer accepts these terms in the version in force at the time of the order.

2. Products

AREPO sells jewellery in precious metals set with laboratory-created diamonds, selected gemstones and pearls.

Laboratory-created diamonds are always declared as such, on every product page, certificate and communication, in accordance with international naming standards. We never use ambiguous terminology.

Product imagery includes photographs and three-dimensional renderings. Renderings faithfully reproduce the technical specification of the piece, but the appearance of light, colour and proportion on screen may differ from the physical object. Natural stones show individual variations in colour and inclusions by their very nature.

The binding characteristics of each piece — metal, fineness, carat weight, cut, dimensions — are those stated on the product page and, where enclosed, in the accompanying gemmological certificate.

3. Prices

All prices are expressed in Swiss francs (CHF) and are final prices: they are the amounts actually payable by the customer for the product. Shipping costs, where applicable, are shown separately before the order is completed.

AREPO is not currently registered for Swiss value added tax; prices therefore do not include a separately stated Swiss VAT amount.

Deliveries outside Switzerland. Shipments to the European Union are made on DAP terms (Delivered at Place): any customs duties, import VAT and clearance fees in the destination country are borne by the customer and are collected by the carrier or the customs authority upon delivery. These amounts are not included in the price shown on the website and cannot be determined by AREPO in advance, as they vary by country and declared value. Refusal of a shipment due to non-payment of such charges does not give rise to any refund.

4. Conclusion of contract

The presentation of products on the website does not constitute a binding offer, but an invitation to order. The contract is concluded when AREPO sends the order confirmation by email.

AREPO reserves the right to refuse an order that is incomplete, manifestly incorrect as to price, or that shows concrete indications of fraud, refunding in full any amounts already paid.

5. Payment

Payment is made in full at the time of the order, using the payment methods offered at checkout. Payment data is processed exclusively by certified payment service providers; AREPO does not store full card details. Production of the piece begins only after the amount has actually been received.

6. Made to order and personalisation

AREPO jewellery is made to order. Unless otherwise stated, each piece is produced after the order is received, according to the specifications chosen by the customer: ring size, metal and — where offered — personalised engraving or dedication.

Preparation times are stated on each product page and refer to the time required to produce, inspect and mark the piece before handover to the carrier. Transit times are additional to preparation times and depend on the carrier and the destination.

The customer is responsible for the accuracy of the data provided for personalisation, in particular the ring size and the text of any engraving. Once production has started, this data can no longer be changed.

7. Right of withdrawal and returns

Customers in Switzerland and Liechtenstein. Swiss law provides no statutory right of withdrawal for purchases made online. AREPO does not grant a contractual right of withdrawal: orders cannot be cancelled or returned once production has started.

Customers in the European Union. For purchases by consumers resident in the EU, the 14-day right of withdrawal under Directive 2011/83/EU applies in principle. That right does not apply, pursuant to Article 16(c) of the same Directive, to the supply of goods made to the consumer's specifications or clearly personalised.

AREPO jewellery falls within this exception where it is produced to order according to specifications chosen by the customer — in particular ring size, choice of metal and any personalised engraving. For such items the right of withdrawal is therefore excluded, and this exclusion is stated on the product page and confirmed at the time of the order.

For any items offered in a fixed standard size and without any element of personalisation, the 14-day right of withdrawal remains available to EU consumers under the statutory conditions. In that case, the intention to withdraw must be communicated in writing to info@areposwiss.com within 14 days of receipt; the product must be returned intact, unworn and complete with its original packaging, certificates and documentation, by tracked and insured shipment at the customer's expense.

In all cases, the exclusion of withdrawal does not affect the statutory warranty for defects described in clause 10: these are two different things. A defective piece remains covered.

8. Sizes and no resizing

AREPO does not resize finished jewellery. The size chosen at the time of the order is final.

We provide a detailed size guide and are available by email before purchase for any questions. An incorrect size communicated by the customer does not constitute a defect of the product and gives rise to no right of replacement or refund.

9. Shipping and transfer of risk

Every order is shipped by tracked and insured carrier, with signature on delivery. Detailed conditions are set out on the "Shipping and Returns" page, which forms an integral part of these terms.

The risk of loss or damage passes to the customer upon delivery, or upon the first unsuccessful delivery attempt for reasons attributable to the customer.

10. Statutory warranty for defects

AREPO is liable for defects in conformity of the product under Swiss law (Art. 197 et seq. of the Swiss Code of Obligations). The limitation period for warranty claims is two years from delivery.

The customer must inspect the product immediately upon receipt and report any obvious defects or transport damage within 48 hours of delivery to info@areposwiss.com, enclosing photographs of the product, the inner packaging and the outer packaging. Hidden defects must be reported as soon as they are discovered.

Where a defect is acknowledged, AREPO will, at its option, repair or replace the piece and bear the shipping costs. If neither remedy is possible, the customer is entitled to a reduction of the price or to rescission of the contract.

Excluded from the warranty are: normal wear, damage resulting from improper use, impact, contact with chemicals or cosmetics, work carried out by third parties, and the customer's choice of an incorrect size.

Mandatory consumer protection provisions of the customer's country of residence remain unaffected where more favourable.

11. Marking, certification and documentation

Precious metal articles are marked with the fineness indication (Au750 for 18 kt / 750 gold) and with AREPO's registered responsibility mark, in accordance with Swiss precious metals control legislation.

Where stated on the product page, the piece is accompanied by the original gemmological certificate issued by the independent laboratory that analysed the stone. The certificate number shown on the document corresponds to the inscription on the girdle of the stone.

The certificate and the documentation received form an integral part of the product: in the event of a warranty claim or of any return, they must be returned together with the piece.

12. Liability

AREPO is liable for damage caused intentionally or through gross negligence. Liability for indirect damage, loss of profit or damage arising from non-conforming use of the products is excluded to the extent permitted by law. Nothing in these terms limits liability for damage to life, bodily integrity or health.

13. Data protection

The processing of personal data is described in the Privacy Policy, which forms an integral part of these terms.

14. Governing law and place of jurisdiction

These contracts are governed by Swiss law, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG).

The place of jurisdiction is AREPO's registered seat in Switzerland. Mandatory provisions on jurisdiction for the protection of consumers remain reserved.

15. Amendments and severability

AREPO may amend these terms at any time. Contracts already concluded are governed by the version in force at the time of the order. Should any provision be invalid, the validity of the remaining provisions is not affected.

16. Governing language

These terms are available in several languages. In the event of any discrepancy between versions, the English version prevails.
